GÖRG Partnerschaft von Rechtsanwälten mbB has successfully advised the Main-Kinzig-Kreis (MKK) on the award of a single-partner framework agreement for the procurement of an overall tele-emergency medical system for the district.
As the most populous and at the same time one of the largest administrative districts in terms of area in the Federal State of Hesse, the MKK is pursuing an innovative and integrative approach in the field of emergency medicine: The so-called "telephone doctor" (TNA) is intended to relieve the emergency medical care in the district and at the same time to supplement it highly effectively by being called in by the crew of the ambulance when needed in order to gain valuable time during treatment. Thanks to live transmission of audio communication, vital signs, photos and videos from the scene, the TNA can get an accurate picture of the patient and make an emergency medical decision if necessary.
After a successful pilot project, the MKK commissioned the provision of an established overall telenotary system as part of the subsequent award procedure, which includes in particular the provision of the appropriate technology for the telenotary services and the operation of the telemedical emergency medical system as well as medical services themselves. At the same time, up to forty ambulances will be equipped accordingly to ensure the legally compliant and highly reliable real-time transmission of data. The operation of the system also includes secure and reliable documentation of the deployment and consultations with regard to patient safety, data protection, personal protection and quality management. Furthermore, the district of Waldeck-Frankenberg was granted an option right to call up the contracted emergency telemedicine services within the framework of a cooperation under public law.
The contract was awarded as a single-partner framework agreement and runs for three years with a one-time unilateral option by the MKK to extend the contract for another year, up to a maximum of four years. The contract was awarded on 10 August 2022. A total of five companies had expressed interest in the contract, with two companies submitting a bid. The award procedure was also distinguished by the performance of a verifying and evaluating test, in which the system offered was comprehensively tested in the context of a fictitious deployment.
