GÖRG Partnerschaft von Rechtsanwälten mbB successfully advised the Main-Kinzig-Kreis - Eigenbetrieb Abfallwirtschaft, the Main-Kinzig district's own waste management company, within the scope of an inter-municipal cooperation on the procurement of waste logistics services in five municipalities of the Main-Kinzig-Kreis.
The scope of services put out to tender included waste management services for the colle ction and transport of waste generated and left in the area of the respective municipality and, in some cases, the provision of containers at building yards, recycling centers and cemeteries, as well as the associated transport and logistics services. A total of four companies took part in the competition.
The lot-by-lot procurement procedure was carried out by means of a negotiated procedure with a preceding competitive bidding process, in which, in addition to price, concepts for complaint and quality management as well as the environmental friendliness and energy efficiency of the vehicles used to perform the collection and transport services were also taken into account in determining the most economical bid. Several rounds of negotiations were held with the bidders as part of the bidding phase.
A GÖRG team led by our Frankfurt attorneys Dr. Heiko Hofmann and Alexander Pustal assisted the Main-Kinzig-Kreis - Eigenbetrieb Abfallwirtschaft in the entire project in terms of procurement and contract law. The GÖRG team also advised on the establishment of the inter -municipal cooperation in the run-up to the procurement procedure.
