Data protection and doping control – a paradox?
So far, the discussion on the GDPR has been conducted on an abstract level and its applicability has hardly been scientifically analysed on the basis of practical examples. This is precisely what the author has set out to do, thereby contributing to the development of a legal doctrine of European data protection law. In doing so, she addresses the important issue of combating doping in national professional sport. In order to combat doping, the National Anti-Doping Agency is dependent on the processing of personal data. The author explains in detail that this processing can be based neither on constitutional legal bases nor on effective consent.
