GÖRG, with a team led by Berlin partner Dr Martin Nentwig, advised the DAH Group on the acquisition of the biogas plant in Ottersberg. The seller is the BENAS Powergroup.
The DAH Group, headquartered in Oranienburg, is an integrated agricultural and energy company with approximately 400 employees. It generates gas, electricity, and heat from renewable energy sources, cultivates over 20,000 hectares of agricultural land, and operates more than 20 biogas plants.
The biogas plant in Ottersberg, Lower Saxony, was designed and constructed by BENAS Biogasanlage GmbH. Recognised as "Biogas Plant of the Year 2024" by the German Biogas Association (Fachverband Biogas e.V.), the facility has a total installed electrical capacity of 11.35 MW. Additionally, it supplies raw biogas to a biomethane upgrading plant, amounting to approximately 55 million kWh annually. The biogas production generates 31 million kWh of electricity per year from renewable raw materials and agricultural residues. Moreover, an innovative paper and fibre moulding production system has been integrated for processing fermentation residues.
With this acquisition, the DAH Group aims to further expand its biomethane production.
GÖRG's legal advice covered all aspects of the transaction, from the entire due diligence process to negotiating and finalising the purchase agreement.
