Oppenheim-Esch-Fonds: GÖRG successfully advises Sparkasse KölnBonn in connection with investor lawsuits concerning Oppenheim-Esch-Fonds Köln-Ossendorf-Hürth I GbR

[Cologne, ] GÖRG Partnerschaft von Rechtsanwälten mbB successfully represented Sparkasse KölnBonn through its Cologne partner Dr. Yorick Ruland in connection with investor lawsuits of the so-called "Oppenheim-Esch-Fonds" concerning the Oppenheim-Esch-Fonds Köln-Ossendorf-Hürth I GbR, which, among other things, leased film and television studios to the former "MMC". The claims for damages asserted by the investors against Sparkasse KölnBonn were also rejected in the second instance, while (former) further defendants had previously concluded settlements with the investors.

Regarding the decision, it was of particular importance that Sparkasse KölnBonn had not taken over the financing of the investments from the beginning. In addition, the 13th Civil Senate of the Higher Regional Court of Cologne had no indication that an obligation to the plaintiffs to point out the possible risks of the fund had already existed by the time the investors joined the fund. The plaintiffs had incurred no causal damage solely through taking over the follow-up financing. Furthermore, there has been no evidence that Sparkasse KölnBonn would have accepted losses of the investors from the outset by the participation in the fund.
