ECJ judgement on customer installations: far-reaching consequences for the energy sector

With its ruling of 28 November 2024, the European Court of Justice (ECJ) has shaken up the German energy sector: The so-called ‘customer installation’ according to Section 3 No. 24a EnWG violates EU law. This has a significant impact on numerous investment projects - particularly in the field of renewable energies.

In her guest article for Energie & Management, lawyer and partner Dr Liane Thau explains the legal and economic consequences of the ruling, the uncertainties for operators and investors and what regulatory adjustments may now be necessary.
