GÖRG Partnerschaft von Rechtsanwälten mbB successfully represented IRONMAN Germany GmbH before the Administrative Court of Frankfurt (Oder): The emergency application by the municipality of Gosen-Neu Zittau for an injunction against the hosting of the 'IRONMAN 70.3 Erkner' event within the municipality's territory was rejected.
The municipality in the Oder-Spree district had filed a last-minute application for interim relief with the relevant administrative court, just over a week before the upcoming event, seeking to prevent the temporary closure of municipal roads for the IRONMAN 70.3 Erkner. In the judicial fast-track procedure, Gosen-Neu Zittau argued that resident access during the event needed to be guaranteed.
In response to this, the two Hamburg-based GÖRG attorneys, Dr. Henning Wendt and Kristina Groß, representing the event organizer, IRONMAN Germany GmbH, submitted a statement to the administrative court on Monday, requesting the rejection of the municipality's emergency application so that the sports event could proceed as planned.
The court followed GÖRG's argumentation and decided on Tuesday that the municipality, as the road construction authority, did not have a 'veto right' regarding the issuance of road traffic permits by the district. Therefore, Gosen-Neu Zittau's approval was not required.
The German IRONMAN season finale with the 5150 Erkner (Olympic distance) and the 4:18:4 Erkner (sprint distance) on Saturday, September 9th, and the IRONMAN 70.3 Erkner on Sunday, September 10th, can proceed as scheduled next weekend in the Brandenburg city of Erkner, in close proximity to Berlin.
