[Cologne, ] The public utility co-operative Trianel GmbH (Aachen) and the energy supplier EWE AG (Oldenburg) have concluded a joint venture for the development, construction and operation of Phase II of the Trianel Windpark Borkum.
Trianel has in cooperation with 33 municipal partners already realized the first phase of the offshore wind farm which started its regular operation in summer 2015. This first phase of the offshore wind farm consists of 40 wind energy turbines with each a capacity of 5 MW. The investment for this Phase I summarized to approximately 1 billion EUR.
In Phase II, up to another 40 wind energy turbines with a total production capacity of about 200 MW will be realized by a joint project company. After the development phase of this second part, collaboratively pursued by the joint venture parties, the final investment decision and financial close are planned for 2016.
GÖRG has successfully advised Trianel on the joint venture, has structured the contract package and has supported Trianel during the negotiations. The legal advice comprised the corporate law structuring including the joint venture agreement setting out the terms for the cooperation, the drafting of project contracts and in particular structuring and implementing a joint infrastructure concept.
Trianel is a long-standing client of GÖRG's and the two have enjoyed close relations for many years. GÖRG has especially acted for Trianel in connection with numerous project developments and financing. Inter alia, the law firm supported Trianel with regard to Phase I of the offshore wind farm Borkum. GÖRG also advised Trianel in connection with the extension of the Trianel gas storage facility in Epe (see our press release of 12 September 2008) and in respect of the acquisition of two onshore wind farms in Brandenburg and Saxony-Anhalt (see press release of 5 August 2014) and an onshore wind farm in Schleswig-Holstein (see press release of 13 April 2015).
