Sustainability in advertising: legal requirements and current developments
Environmental aspects have long been an integral part of our everyday lives. The targeted addressing of target groups through advertising references to environmental compatibility and environmental protection is becoming increasingly important. A frequently used means is advertising with CO₂ offsetting through the use of CO₂ certificates.
However, this form of advertising obliges companies to actually guarantee the advertised environmental compatibility. Consumer associations are increasingly scrutinising such statements and taking legal action if the promised standards are not met. European case law is also increasingly dealing with the regulation of advertising statements, known as ‘green claims’.
So how can companies advertise with terms such as CO₂ compensation in a legally secure manner in the future?
