The authors Dr. Alexander Insam, Lars Hinrichs and Dr. Martin Hörtz show the difficulties that have arisen in practice with the clash of banking supervisory and labour law regulations due to the Remuneration Ordinance for Institutions (Institutsvergütungsverordnung) since 2010 and offer initial practical experience so that institutions can master these challenges in practice and the theoretical risk protection cloak desired by the legislator does not have to become a practical straitjacket for the banks.
